Steps to ensure speedy justice in AJK announced: The Dawn, Feb 11

MUZAFFARABAD, Feb 10: Declaring 2010 as ‘judicial year’, Azad Jammu and Kashmir (AJK) High Court Chief Justice Ghulam Mustafa Mughal on Wednesday announced several decisions for easy and speedy dispensation of justice as well as revival of the trust of public in judiciary.

In his maiden interaction with the media after assuming the office on January 1, Justice Mughal said he had decided to introduce the concept of self-accountability from the upper level instead of creating panic in the subordinate judiciary with regard to clearance of the backlog.

He said the workload had been created due to lack of a proper transfer policy in government departments, particularly the education department, which drove the affected parties to seek redress from the high court although service matters were not within its jurisdiction.

The HC shall try its best to avoid entertaining writ petitions in service matters except where it was authorised to issue the ‘writ of prohibition,’ he added.

The CJ said stay orders would be granted for the minimum possible period and in develop projects, the same shall not be granted without serving a show-cause notice on the department concerned. He said all civil and criminal appeals shall have to be settled within 90 days whereas revision civil appeals and miscellaneous applications shall have to be settled in 60 days. In criminal cases, miscellaneous applications shall have to be settled within 15 days.

In the family matters, he said, the family court will have to decide cases within four months in accordance with the relevant act whereas the Shariat Court will have to decide within 60 days.

The subordinate judiciary has been directed to hear murder cases on a daily basis. He said district judges had been directed to devise a strategy whereby subordinate courts should clear 50 per cent of backlog and 50 per cent of new cases.

The CJ said a three-member supervisory and controlling committee headed by registrar HC and comprising registrar Shariat Court and one more member, had been constituted by him to present him performance reports on weekly basis.
