Govt again directed to suspend Hussain Asghar as GB IG

ISLAMABAD: The Supreme Court on Wednesday again directed the government to suspend the appointment of Hussain Asghar as Gilgit-Baltistan Police inspector general over non-compliance of the apex court order.

A three-member bench of the apex court, headed by Chief Justice Iftikhar Muhammad Chaudhry and comprising Justice Jawwad S Khawaja and Justice Khilji Arif Hussain, is hearing a suo motu case of corruption in arrangements for Hajj 2010.

During the hearing, the court asked Attorney General Irfan Qadir to suspend Hussain Asghar and bring it to the notice of Prime Minister Raja Pervez Ashraf that Asghar, despite the apex court order, is not reporting back to the FIA Headquarters.

The AGP replied that suspension was the main problem, and asked the court to summon him and suspend his notification as Gilgit-Baltistan Police IG. He, however, informed the court that Imtiaz Inayat Elahi had been appointed as an inquiry officer to initiate departmental proceeding against Hussain Asghar for non-compliance of the court order.

The chief justice, expressing concern over the prevailing situation, questioned how was it possible that the federal government was ordering an officer to report back and he was continuously refusing to do so. He said there would be no comprise on the prestige of the court.

Justice Jawwad S Khawaja said the matter was very simple. It did not pertain to a person, but to the rule of law. He questioned how the government could ensure supremacy of Section 10 Civil Servants Act.

The court, a number of times, has ordered the federal government to suspend Hussain Asghar forthwith, but each time the government comes up with a novel excuse. Establishment Secretary Khushnood Lashari himself committed to the court that Hussain Asghar’s services would be suspended if he does not report back to the FIA Headquarters immediately.http://www.dailytimes.com.pk/default.asp?page=2012\07\19\story_19-7-2012_pg7_14
