B’desh: How do militants get bail?

There is hardly any use of nabbing so many militants in such effective operations if they are simply released again on bail. It is a matter of concern that over the past six months, 148 militants have been set free in this manner. It is very important to determine the loopholes in the law through which they are slipping out. After all, there are several instances where released militants simply go back to committing misdeeds.

The police apprehend that the release of the militants will lead to further danger. It is difficult to keep watch on so many of these militants. The question is, how are so many militants being granted bail? The police or law enforcement cannot evade responsibility. It is the police’s responsibility to provide adequate evidence against the accused and place charge sheets against them in court. Delay in these matters gives the suspected militants the chance to avail bail.

Everyone has a right to bail and, at the same time, it is imperative that justice is ensured. But when it comes to those who are a danger to society, it is important for the police to prove that they are dangerous and that they do not warrant bail.

The stage is all set for bail by the delays in the judicial process, the charge sheets not being timely submitted, lack of evidence, and so on. The prosecution is responsible too. The state counsels fail to put up strong arguments in court against the bail petitions.

After the Holey Artisan attack last July, the government stepped up its anti-militant drive. The law enforcers unearthed many militant dens and carried out operations. Many militants were killed and many arrested. Fresh threats arise when the arrested militants are freed.

It is extremely important for charge sheets to be submitted against accused and suspected militants, to bring evidence forward and to ensure speedy trial.
