ISLAMABAD, March 17: The Supreme Court of Pakistan observed on Wednesday that it had the jurisdiction to proceed with a case relating to the appointment of the chief justice of the AJK Supreme Court.
A bench comprising Chief Justice Iftikhar Mohammad Chaudhry, Justice Chaudhry Ijaz Ahmed and Justice Khalilur Rehman Ramday said it was not concerned about a restraining order issued by Azad Kashmir’s apex court to the chairman of the AJK Council.
The bench was hearing petitions by Justice Syed Manzoor Hussain Gillani of the AJK Supreme Court seeking directives for approval by the prime minister of a summary for his appointment as chief justice.
The petitioner requested that instructions be given to the prime minister of Pakistan to issue a fresh advice as chairman of the AJK Council for his appointment as the chief justice of Azad Jammu and Kashmir Supreme Court and directives to the AJK president to implement it.
The issue was compounded on Monday when AJK Supreme Court Chief Justice Riaz Akhtar Chaudhry issued a stay order retraining the AJK Council and its chairman, Prime Minister Yousuf Raza Gilani, from altering the situation or issuing a fresh advice regarding the appointment.
He also ordered the AJK law and justice department not to issue any notification if a fresh advice was issued by the chairman. On Wednesday, Attorney General Anwar Mansoor told the court that the prime minister could not take up Justice Gillani’s application because he was extremely busy and he might decide the matter in two weeks.
The court had asked the attorney general to request the prime minister to settle the matter as soon as possible.
