Military courts in GB to be illegal: Asma : report in The News, January 15, 2015

ISLAMABAD: Former president of Supreme Court Bar Association (SCBA) Asma Jehangir has said that there is no mention of Gilgit-Baltistan (GB) in the 21st Constitutional Amendment, and therefore the formation of military courts in GB is illegal and unconstitutional.
She asked if the 342 parliamentarians could not sustain the pressure with regard to formation of the military courts, how the 17 judges of the Supreme Court could do the same.Talking to journalists on the premises of the Supreme Court building here on Wednesday, Asma Jehangir said that some had placed their desired people in the media and like politicians, the lawyers were also not doing their work well, therefore, the people of their liking should be also be planted there.
She raised the question that if there was intelligence report with regard to the Peshawar carnage, why measures were not taken to prevent the tragedy.She questioned why the personnel of law-enforcing agencies reached site of the massacre with a delay of two hours and who was held responsible for this.
She further queried whether Peshawar massacre was caused by the failure of law-enforcing agencies or that of the judiciary, and why the questions in this regard were not raised in the Parliament. To a question, she said that SCBA was against the formation of the military courts.She said that if extra-constitutional measures were taken in the military courts, they could be challenged in the apex court.
