AJK SC bars issuance of fresh advice, notification

MUZAFFARABAD, March 15: A full-bench of the AJK Supreme Court restrained the AJK Council and its chairman (prime minister of Pakistan) on Monday from issuing any fresh advice or reviewing or re-opening the advice already submitted in Oct 2006 by the council about appointment of Justice Riaz Akhtar Chaudhry as Chief Justice.

The AJK law department was also stopped by the bench, headed by Chief Justice Riaz Chaudhry himself and comprising Justice Khawaja Shahad Ahmed and Justice Chaudhry Azam Khan (ad hoc judge), from issuing any notification if a fresh advice was issued by the AJK Council.

The bench also restrained the AJK president from issuing any order (in line with a fresh advice) and subsequently administering oath to any other person for the CJ office till further orders.

The ad-interim order was issued by the bench on a constitutional petition jointly filed by an AJK minister and five pro-CJ lawyers, one of whom is counsel for the petitioners.
